The Director of Public Prosecutions has secured a life imprisonment sentence against Hussein Buya Omar, a man in his 50s convicted of committing incest with his teenage daughter in Tana River County.

The conviction was delivered by Edward Too, a Senior Principal Magistrate at the Hola Law Courts, who found the accused guilty of incest contrary to Section 20(1) of the Sexual Offences Act.

The court heard that the offence occurred on several occasions in Mkomani Village, within Mazuni Location in Tana River County, where the accused repeatedly abused the school-going girl despite being fully aware that she was his daughter.

Prosecution, led by Alfred Michukiand Elijah Oruko presented a strong case supported by seven witnesses. These included the minor, her mother, the area chief, a clinical officer and the investigating officer. Medical evidence, including the P3 form, treatment notes and the child’s birth certificate, corroborated the victim’s testimony and linked the accused to the offence.

Hon. Too, in his judgement, described the victim’s account as consistent, credible and free from malice. The court dismissed the accused’s defence as a mere denial and ruled that the prosecution had proved its case beyond reasonable doubt.

Consequently, the court sentenced Hussein Buya Omar to life imprisonment.
