The Director of Public Prosecutions (DPP) has secured a major conviction in an assault case involving a police officer in Mandera County.

Abdihakim Abdi Saman, attached to the Mandera Border Police Post, was convicted by the Mandera Magistrates Court for the offence of grievous harm contrary to Section 234 of the Penal Code, as well as a second count of assault.

The court heard that on 11th May 2024, while at Mandera Police Station, the accused unlawfully inflicted grievous harm on Dahaba Noor Hillow. He was also found to have assaulted Ali Abdirahman Maalim during the same incident. The matter was investigated by the Independent Policing Oversight Authority (IPOA), leading to his arraignment.

Prosecution, led by Patrick Namiti, Lee Kadenyo and Mr. Kasyoka, presented 12 witnesses whose testimonies firmly placed the accused at the scene as the defence, which called six witnesses, failed to dislodge the prosecution’s evidence.

In his judgment delivered on February 20, 2026, Hon. Omondi ruled that Prosecution had proved its case beyond reasonable doubt, dismissing the accused’s alibi defence as unsubstantiated.

Sentencing is scheduled for February 26, 2026.
