Two middle-aged men have been sentenced to death by the Wajir Law Courts after being convicted on six counts of robbery with violence.

Wajir Senior Principal Magistrate Hon. Eric Malesi convicted John Mwaura and Muia Mutuku on six counts of robbery with violence, contrary to Section 296(2) of the Penal Code, Cap. 63, Laws of Kenya.

The prosecution, led by Assistant Director of Public Prosecutions (ADPP) Robert Nyoro, told the court that between 2024 and 2025, the two accused planned and executed a series of armed robberies across Wajir County.

ADPP Nyoro further told the court that in the course of their criminal acts, the duo was armed and used extreme force and violence, resulting in the death of one of their victims.

Forensic evidence and digital tracking placed the duo at all the crime scenes, while CCTV footage further corroborated this, definitively identifying the two accused and strongly linking them to the crimes.

In determining the case, Magistrate Malesi ruled that the prosecution had proved all the key elements of the offences to the required legal standard.

He further found that the two accused had committed the robberies while armed and using extreme violence.
“In sentencing the two, the court noted the need for a deterrent sentence in line with the law’s provisions on robbery with violence.

The court also took into account the loss of life caused by the actions of the accused. The court finds the accused persons guilty on the charges and imposes the death sentence in accordance with the law,” he said.

The two were granted 14 days to appeal the decision.
