The case of the attempted murder of former Garissa Finance executive Idris Mukhtar will proceed on February 8–9 next year.
Businessman Mohamud Hussein Aden and Juliet Charity Njoki had denied attempting to kill Mukhtar on May 19, 2018, in Nairobi.
The case was scheduled for hearing before chief magistrate Francis Andayi but could not proceed as the magistrate had been transferred to another station.
New chief magistrate Micheni Wendy, the prosecution and defence lawyers, led by Danstan Omari, therefore, agreed to have the matter proceed as rescheduled.
The accused had also denied a conspiracy to kill lawyer Charles Kanjama, an offence they allegedly committed between July 1 and September 27, 2018, in Nairobi.
According to the prosecution, the accused persons, jointly with others not before court, attempted to kill Mukhtar at White Star Restaurant along Kandara Road in Kileleshwa.
Immediately after the shooting, Mukhtar was admitted to the ICU at a Nairobi hospital before he was transferred to India.
A prime suspect died in a Parklands police station cell where he was being held for interrogation. David Mwai, 27, allegedly committed suicide after recording a confession with detectives.
During investigations, police arrested several other people mentioned adversely by witnesses. They included Garissa Governor Ali Korane and his brother.
The county chief, his brother and others were released. But Mukhtar’s family insisted they were involved in the plot to kill their son after he questioned the governor’s education. Korane said he had nothing to do with the attempted murder.
