Wajir Deputy Governor Ahmed Muhumed Abdi is facing a potential ouster from office following the tabling of an impeachment motion at the Wajir County Assembly. The motion cites gross violation of the Constitution, abuse of office, and gross misconduct.

A letter seen by Frontier Online outlines the motion sponsored by Abdirashid Hussein, Member of County Assembly (MCA) for Burder Ward.

It details serious allegations against the Deputy Governor and calls for his immediate removal under Article 181(1)(a) and (c) of the Constitution of Kenya, 2010.

Grounds for Impeachment

The motion, anchored on multiple constitutional and statutory provisions, accuses the deputy governor of soliciting and receiving bribes, abusing his office for personal gain, and engaging in unethical conduct.

He is alleged to have requested a bribe of Ksh 8 million from Mr. Ahmed Korane, promising in return to secure a tender for renovation works at the Deputy Governor’s office. Furthermore, he reportedly received Ksh 1.6 million from the director of Nurki Borehole Drilling and Construction Company in exchange for facilitating borehole drilling and equipping tenders in the county.

Altogether, the motion claims that the Deputy Governor solicited a total of Ksh 9.6 million. These actions, according to the MCA, constitute a gross violation of constitutional provisions, particularly Articles 10, 73, 75, and 232, which emphasize transparency, accountability, and integrity in public office.

Abuse of Office and Leadership Failures

The motion also references the Leadership and Integrity Act, Public Officers and Ethics Act, and the Bribery Act to further justify the impeachment. The deputy governor is accused of favoritism, nepotism, and using confidential government information for personal enrichment.

These actions allegedly breach Section 11 of the Public Officers and Ethics Act, which prohibits public officials from accepting favours or using their position for private benefit. Similarly, the Bribery Act forbids soliciting or receiving financial advantages in exchange for performing official duties improperly.

The motion portrays the deputy governor’s conduct as unbecoming of a state officer and a betrayal of the public trust bestowed upon him by virtue of his office.

Speaking to Exclusively to Frontier Online, Burder MCA Abdirashid Hussein confirmed that 18 MCAs have appended their signature to the Motion, adding that the number could increase as political lobbying intensifies behind the scenes.

Legal Threshold for Impeachment

Under Section 33 of the County Governments Act and Article 181 of the Constitution, a motion to impeach a Deputy Governor must be supported by at least one-third of all MCAs to be tabled for debate. For it to pass, it requires a two-thirds majority vote of all members of the County Assembly. If passed, the motion is then forwarded to the Senate, which conducts a trial to determine whether the Deputy Governor should be removed from office.

This means the support of at least 18 MCAs, as reported, could meet the initial threshold for debate — while a larger coalition would be required to pass the motion and send it to the Senate.

If passed by the County Assembly, the impeachment motion will proceed to the Senate for trial, in accordance with the law and Wajir County Assembly Standing Orders No. 75 and 76.

This unfolding political drama has drawn significant public interest across Wajir County, as residents await the Assembly’s decision on the Deputy Governor’s fate.
