GARISSA – The High Court has stopped the disbursement of funds to the Garissa County following a petition filed by Mohamed Hassan Ahmed (Kinglary).
The court instead the Controller of Budget and National Treasury to halt any disbursement of funds until January 25 next year when the matter will be mentioned.
According to the petition, the Chairperson finance budget and appropriation committee through the clerk office submitted a report on the 1st supplementary estimate of revenue and expenditure for FY 2022-2023.
The report indicated that the committee had conducted public hearings on the supplementary budget, but no written submissions and memorandum was received by both Executive and Legislative.
“The petitioner avers the said ascertain is untrue since no member of public was invited by a way of public notice in the Kenyan Gazette to give their view in line with article 196 (1) (b) of the Constitution of Kenya, 2010 and section 87 of the county government Act No 17 of 2012, the petitioner therefore avers there was no public participation, a key requirement and element that every state organ, state officer or public officer is obliged to uphold when making public policy decisions,” the court papers stated.
