NAIROBI- Meru based High court has ruled the impeachment of former Wajir Governor Mohamed Abdi Mohamud by the County Assembly and the Senate as null and void.
The court said that Mohamud was not removed from office legally adding that ther was no public participation when the decision to impeach the governor was hatched and implemented by the County Assembly Members.
His deputy Ahmed Ali Muktar who had assumed as governor was thus instructed to resume his prior position of deputy governor until the remaining five months to the general elections.
“Mohamed Abdi Mohamud was not removed from office legally… The swearing-in of Ahmed Mukhtar as the governor of Wajir and the appointment of Hashim Musa as deputy governor is therefore null and void,” ruled the court
Mohamud went to court to seek redress of a decision by the County Assembly to impeach him which was subsequently upheld by the Senate in May last year.
The Senate found Mohamud of having deteriorated the county health docket which they said could hamper the issuance of services to the Wajir People.
Power struggle could again resurface in the county as the two could possibly fight over who is the legitimate county boss.
Abdi had on September last year stormed the county offices armed with a court order and flanked by security officers wanting to resume duties however his efforts were not successful.
It is a matter of wait and see as fresh power upheaval again rocks Wajir five months shy from the August General elections.
No Statement was forthcoming from the camp of Ahmed Muktar, the current governor by the time of compiling this report.
The court also ruled that the governor of wajir to formally assume office on 10th march 2022, to enable affected parties to file an appeal if they so wish.
